Terms of Service

1. Agreement to Terms

By accessing or using Servana Pro (the "Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our Platform. These terms apply to all users of the Platform, including customers and service professionals.

2. Services Description

Servana Pro is a platform that connects customers with verified home service professionals. We provide a marketplace for services including but not limited to plumbing, electrical work, cleaning, painting, carpentry, and AC repair.

  • We do not directly provide home services ourselves. We are not an employer of the professionals listed on our Platform.
  • We are not responsible for the quality, safety, or legality of services provided by professionals listed on our Platform.
  • All service agreements are solely between the customer and the professional.
  • We do not guarantee the availability of any particular professional or service.

3. User Accounts

To use certain features of our Platform, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security of your account and password.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.
  • Be at least 18 years of age to use our Platform.
  • Not use the Platform for any illegal or unauthorized purpose.

4. User Conduct

You agree not to:

  • Use the Platform in any way that violates any applicable law or regulation.
  • Infringe upon or violate our intellectual property rights or the intellectual property rights of others.
  • Harass, abuse, intimidate, or threaten any other user of the Platform.
  • Upload, post, or transmit any defamatory, offensive, obscene, or otherwise objectionable material.
  • Interfere with or disrupt the Platform or servers or networks connected to the Platform.
  • Use any robot, spider, or other automatic device or manual process to monitor or copy any content from the Platform without our prior written permission.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

5. Professional Obligations

Service professionals using our Platform agree to:

  • Provide accurate information about their qualifications, experience, and services offered.
  • Comply with all applicable laws, regulations, and licensing requirements.
  • Perform services in a professional, safe, and timely manner.
  • Maintain appropriate insurance coverage as required by law.
  • Not engage in any fraudulent, deceptive, or unethical practices.
  • Respect the privacy and property of customers.

6. Payment Terms

All payments for services are processed through our Platform. You agree to pay all fees and charges associated with your use of the services. We reserve the right to modify our pricing at any time.

  • Prices for services are set by the professionals and may be subject to change.
  • You authorize us to charge your selected payment method for all fees and charges incurred through your account.
  • All payments are non-refundable except as provided in our Refund Policy.
  • We are not responsible for any additional fees charged by your payment provider.

7. Intellectual Property

The content on Servana Pro, including text, graphics, logos, images, and software, is the property of Servana Pro and is protected by copyright and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works from our content without our prior written permission.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SERVANA PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM OR SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE LAST TWELVE (12) MONTHS.

9. Indemnification

You agree to defend, indemnify, and hold harmless Servana Pro and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of and access to the Platform, your violation of any term of these Terms of Service, or your violation of any third-party right.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms of Service. Upon termination, your right to use the Platform will immediately cease.

11. Changes to Terms

We reserve the right to modify or replace these Terms of Service at any time. We will notify you of any changes by posting the new Terms of Service on this page and updating the "Last updated" date at the top of these Terms. Your continued use of the Platform after any such changes constitutes acceptance of the new Terms of Service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions. Any legal actions or proceedings arising under these Terms shall be brought exclusively in the courts of Kathmandu, Nepal.

13. Dispute Resolution

Any dispute arising from or relating to these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration association.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable.
